Meta is updating its policies on Cannabis-related products. Yes, you heard that right, we will soon have new Cannabis policies from Meta! The new rules include updated rules on how CBD advertisers must conduct their promotions on Meta. Meta is renaming its ‘Hemp & Related Products’ ad policy to ‘CBD & Related Products’. The policy change will cover a broader scope of legally permissible CBD products in the US.

High Expectations

The new Cannabis policies from Meta lifts some restrictions from advertisers:

  • Promote or offer the sale of hemp products that don’t contain CBD or >0.3% THC (e.g. hemp seed and hemp fiber) in Canada, Mexico and the United States, provided that they comply with all applicable local laws, required or established industry codes and guidelines.

  • Educate, advocate, or give public service announcements related to CBD and related products, provided that such ads don’t offer any prohibited products for sale.

Meta reminds advertisers that ads promoting THC products or Cannabis products with psychoactive components are still prohibited. Meta will also allow the promotion of CBD products certified by Legitscript. These aforementioned products require written permission from Meta upon obtaining Legitscript certification, complying with applicable local laws.

To top it off, ads for CBD products are also not eligible for targeting users under 18 years. The new policies only relate to advertisers in the regions mentioned above, based on local laws and restrictions. Meta notes that products falling under its Prescription Drugs policy are not part of this update.

Given how the rules around Cannabis use are changing, every platform has begun updating their respective policies. Besides Meta, Twitter also recently updated its regulations around CBD promotions. We do not know whether that’s a good thing for Twitter, but let us give it the benefit of the doubt.

The Wrap

US regulators are shifting their perceptions of Cannabis products. As more of the law becomes open to this shift, it makes sense for platforms to capitalize on the trend. Aligning with this could facilitate more ad opportunities, but it is also important to note each state’s legal requirements. Nevertheless, the rules are changing, and new Cannabis policies from Meta only mark the start of a new marketing era.
